1. About FansDetect

FansDetect operates as a search and discovery platform that helps users find creator profiles available on third-party platforms.

FansDetect may display or index information that is publicly accessible on the internet, including usernames, display names, profile images, biographies, categories, publicly listed profile information, and links to creators' official pages.

FansDetect does not sell subscriptions to creators' content and does not provide access to private, subscriber-only, paywalled, leaked, stolen, or unlawfully obtained content.

Content purchases, subscriptions, and other transactions with creators take place on the applicable third-party platforms.

2. Profile Removal / Delisting

A formal DMCA notice is not required simply because a creator would prefer that their profile not appear on FansDetect.

Creators and their authorized representatives may request removal of a profile from FansDetect through the profile removal or reporting functionality made available on the website.

A removal request should identify:

  • The URL of the profile on FansDetect;
  • The URL or username of the corresponding creator account; and
  • Sufficient information to demonstrate control of or authorization to represent the relevant profile.

FansDetect may request additional information where reasonably necessary to verify a removal request.

Removal from FansDetect affects only FansDetect's own website and index. It does not remove content from third-party platforms, search engines, or other websites.

3. Copyright Infringement Notices

If you believe that material available on FansDetect infringes copyright that you own or are authorized to enforce, you may submit a copyright infringement notice through the reporting mechanism made available on FansDetect.

For a DMCA notice to be effective, it should include the following information:

Identification of the Copyrighted Work

Identify the copyrighted work that you believe has been infringed.

If the complaint concerns multiple copyrighted works, a representative list of those works may be provided where permitted by applicable law.

Identification of the Material

Provide the specific URL or URLs on FansDetect where the allegedly infringing material appears, together with sufficient information to allow FansDetect to locate the material.

Where a direct URL is available, screenshots, usernames, search terms, or general descriptions alone may not be sufficient.

Claimant Information

Provide sufficient information to identify and communicate with the person submitting the notice, together with the claimant's relationship to the copyright owner where the notice is submitted on behalf of another person or entity.

Good-Faith Statement

The notice must contain a statement confirming that the claimant has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

Accuracy and Authority Statement

The notice must include a statement, made under penalty of perjury, that the information contained in the notice is accurate and that the claimant is the copyright owner or is authorized to act on behalf of an owner of an exclusive right that is allegedly infringed.

Signature

The notice must contain the physical or electronic signature of the copyright owner or a person authorized to act on the copyright owner's behalf.

4. Review of Copyright Notices

Upon receipt of a substantially complete copyright infringement notice, FansDetect may review the identified material and take appropriate action.

Such action may include:

  • Removing or disabling access to identified material;
  • Removing relevant material or pages from the FansDetect index;
  • Preventing removed material from being re-indexed where reasonably practicable;
  • Requesting additional information from the claimant;
  • Notifying an affected party where appropriate; and
  • Taking action regarding repeat infringement where applicable.

FansDetect may decline to act on notices that are incomplete, fraudulent, abusive, misleading, or that do not reasonably identify the material at issue.

5. Counter-Notification

If material has been removed or disabled as a result of a copyright infringement notice and the affected party believes that the removal resulted from a mistake or misidentification, that party may submit a counter-notification through the reporting mechanism made available on FansDetect.

A counter-notification should include:

  1. A physical or electronic signature;
  2. Identification of the material that was removed or disabled and the location where it appeared before removal;
  3. A statement under penalty of perjury that the submitting party has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Sufficient identifying and contact information as required by applicable law; and
  5. Any statements regarding jurisdiction and acceptance of service of process required under 17 U.S.C. § 512(g).

Where applicable, FansDetect may forward a valid counter-notification to the party who submitted the original infringement notice.

Material may be restored in accordance with applicable law unless FansDetect receives notice that the complaining party has initiated a court action seeking to restrain the allegedly infringing activity.

6. Misrepresentations and Abuse

False, misleading, fraudulent, or abusive copyright claims should not be submitted to FansDetect.

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled as a result of mistake or misidentification, may be liable for damages, costs, and attorneys' fees.

Before submitting a copyright notice or counter-notification, claimants should consider whether the disputed use is authorized by the copyright owner, permitted by law, or subject to an applicable limitation or exception.

7. Repeat Infringement

FansDetect maintains a policy regarding repeat copyright infringement.

Where appropriate and applicable to the nature of the service, FansDetect may restrict or terminate access by parties who repeatedly infringe the intellectual property rights of others.

FansDetect may also remove or restrict material that infringes intellectual property rights even where repeat infringement has not occurred.

8. Third-Party Websites

FansDetect may contain links to websites, profiles, and services operated by third parties.

FansDetect does not control third-party websites and cannot remove material directly from services that FansDetect does not operate.

Removal of material or a profile from FansDetect does not automatically result in removal from the original source, third-party platforms, search engines, or other websites that may independently display or index the same information.

Copyright complaints concerning material hosted by another service may need to be submitted separately to the operator of that service.

9. No Legal Advice

This policy is provided for informational purposes and explains FansDetect's copyright complaint procedures. It does not constitute legal advice.

FansDetect does not provide legal advice regarding copyright ownership, licensing, fair use, or whether a particular use constitutes infringement.

Persons uncertain about their legal rights or obligations should consider obtaining advice from a qualified legal professional.

10. Changes to This Policy

FansDetect may update this DMCA & Copyright Policy from time to time.
